Volitio End User License Agreement (EULA) and Terms & Conditions

Welcome to Volitio: This End User License Agreement ("EULA") and Terms & Conditions ("Agreement") is a legally binding contract between you ("User", "you", or "your") and Volitio ("Company", "we", "our", or "us"), governing your access to and use of the Volitio mobile application, website and related services (collectively, the "Platform"). by downloading, accessing, or using the Platform, you consent to be bound by the terms of this Agreement.If you do not agree to these terms, please discontinue the use of the Platform immediately.
1. INTRODUCTION
1. License Grant Volitio grants you a limited, non-exclusive, non-transferable, revocable license to use the Platform strictly in accordance with the terms of this EULA. This licnese is for personal and non-commercial use only. You are prohited from using the Platform in any manner that could damage, disable, overburden, or impair the Platform or interfere with any other party's use and enjoyment of the Platform.
2. Account Registration
2.1 Sign-Up and Login: You must register for an accout to use certain features of the Platform, providing accurate and current information. You are responsible for all activities that occur under your account and must maintain the security of your password.
2.2 Apple Sign-in: Apple Sign-In is available for ease of access. If using Apple Sign-In, ensure that the account already exists as this method cannot be used to create a new account.
3. Location Services
Enabling location services allows the Platform to:
- Locate and suggest verified support workers nearby.
- facilitate matches between support workers and service users based on geographic proximity.Consenting to use of locaton sevicees enables these functionalities
4. User Responsibilities
4.1 Accurate Information Ensure that all information you provide on the Platform is truthful, complete, and updated regularly.4.2 Compliance with Laws: You are required to use the Platform in compliance with all applicable local, state, national, and international laws and regulations.4.3 prohibited Conduct: You agree not to engage in unacceptable use of the Platform which includes, without limitation, infringement of others' intellectual property rights, transmitting harmful or malicious content, or engaging in harrasing, abusive or discriminatory behavior.
5. Service Availability
Volitio aims to ensure the Platform is accessible at all times, but acknowledges that there are factors, inckuding maintenance and security risks, that may impact availability. We are not liable for any Platform downtime.
6. Content and Intellectual Property
6.1 Ownership: The Platform and all content within it, including texts, graphics, logos, icons, images, and software, are owned by Volitio or its licensors and are protected by international copyright and intellectual property laws.
6.2 User-Generated Contents You retain ownership of your content, but grant Volitio a perpetual, non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, modify, create derivative works, perform, and distribute your content on the Platform for the purposes of operating and providing the Platform to you and to other users.
7. Privacy and Data Protection
Our commitment to your privacy is paramount. The collection, use, and sharing of personal information are detailed in our Privacy Policy, adhering to Australian privacy laws and NDIS regulations.
8. Reporting Abuse
8.1 Report Abuse: If you encounter abuse on the Platform, please use the provided tools to report it. Volitio takes these reports seriously and will take appropriate actions based on our policies and the law.
9. Termination
We may terminate or suspend your account and bar access to the Platform without prior notice or liability, for any reason, including without limitation if you breach the Terms.
10. Limitation of Liability
Volitio will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
12. Changes to the EULA
We reserve the right to modify these terms at any time. We will provide notice of these changes by revising the date at the top of this document and posting the amended terms. Your continued use of the Platform after the effective date of the updated EULA constitutes your agreement to the updated terms.
